Please read carefully. By agreeing below, you are waiving certain legal rights.
1. Acknowledgment of Risk
I understand that participation in sports camps, training programs, and recreational activities offered by RWC Buffalo Run (the “Organization”) involves inherent risks to my child.
These risks may include, but are not limited to:
- Slips, falls, and collisions
- Sprains, strains, or fractures
- Concussions or head injuries
- Equipment-related injuries
- Illness, including communicable illnesses
- Heat-related conditions
- Injuries resulting from the actions of other participants
- Other physical injuries such as, internal injuries, permanent impairments, and even paralysis
I acknowledge that these risks are inherent to my child participating in athletic and recreational activities and may occur even when reasonable care is exercised.
I voluntarily allow my child to participate knowing these risks exist.
2. Waiver and Release of Liability
In consideration of my child being permitted to participate, I agree on behalf of myself and my child to release, discharge and hold harmless:
RWC Buffalo Run, and its affiliates, and their respective owners, directors, officers, employees, coaches, volunteers, contractors, servants and agents (collectively, the “Releasees”), from any claims, demands, actions, or causes of action for injury, loss, or damage arising out of my child’s participation in camp activities, including those arising from the negligence of the Organization and/or Releasees, or otherwise, including without limitation, negligent first aid attempts, except where such liability cannot be excluded under Manitoba law.
I covenant not to make or bring any such claim against the Organization or any Releasee, and forever release and discharge the Organization and the Releasees from liability under such claims; and further agree that if, despite this Acknowledgement of Risk, Waiver and Release of Liability, my minor child, or anyone on the minor child’s behalf, makes a claim against the Organization and/or the Releasees, I will indemnify, save and hold harmless the Organization and/or the Releasees, as applicable, from any litigation expenses, attorney fees, loss, liability, damage, or cost which any and all of them may incur as the result of any such claim.
This waiver and release of liability applies to all activities conducted at the facility and any organized off-site activities, and transportation thereto, as applicable.
3. Medical Authorization
I authorize camp staff to provide basic first aid and to seek emergency medical treatment for my child if necessary.
I understand that:
- Every reasonable effort will be made to contact me in an emergency.
- I am financially responsible for any medical treatment required.
4. Health Disclosure
I confirm that all known medical conditions, allergies, and relevant health concerns have been disclosed during registration.
I understand and agree that it is my sole responsibility to obtain and provide accurate medical information, and failure to do so may increase risk.
5. Participant Conduct
I understand that:
- Participants must follow staff instructions at all times.
- Unsafe, disruptive, or aggressive behavior may result in removal from camp.
- No refund will be issued in the event of removal due to serious misconduct.
6. Photo & Media Consent
I grant permission for the Organization to photograph or record my child during camp activities for promotional and marketing purposes.
If I do not consent, I will notify the Organization in writing prior to the start of camp.
7. Cancellation & Refund Policy
I understand that:
- Registration fees are non-refundable unless otherwise stated in writing.
- Transfers may be permitted at the discretion of the Organization.
- If camp is cancelled by the Organization, a refund or credit will be issued.
8. Acknowledgment & Agreement
This Agreement shall be governed by and construed in accordance with the laws of Manitoba and the federal laws of Canada applicable therein.
I confirm that:
- I am the parent or legal guardian of the participant.
- I have read and understand this agreement and the nature of the activities and my child’s experience and capabilities in relation to the activities.
- I believe my child is qualified, in good health and in proper physical condition to participate in the activities.
- I understand that by agreeing, I am waiving certain legal rights, including the right to sue for negligence, except where such rights cannot be waived under Manitoba law.
- I agree voluntarily.
I also confirm that, I am of lawful age and legally competent to sign this Acknowledgement of Risk, Waiver and Release of Liability (“Release”), and I am not relying upon any oral or written representations or statements made by the Organization other than what is set forth in this Release.
